Sexually Explicit Trademarks Are Now Legally Protected
On Friday, the United States Court of Appeals for the Federal Circuit has allowed the registration of the trademark FUCT for a clothing brand. The Court agreed that "the mark comprises immoral or scandalous matter," since it is pronounced the same as the past tense of the vulgar verb "fuck." Registering vulgar trademarks would not have been allowed until June which is when the U.S. Supreme Court ruled that denying immoral or scandalous language in trademarks is an unconstitutional restriction of free speech. FUCT brand also produces a line of clothing branded as SSDD ("Same Shit Different Day").
